Visa d'établissement, carte de travail & the mining-zone question

There is no residence permit separate from the visa: the visa d'établissement IS the residence status, granted on the DGM Director-General's decision under a 1987 ordinance. Before it comes the biometric carte de travail from the Commission Nationale de l'Emploi des Étrangers — a precondition of the work establishment visa, not a consequence of it. Provincial applicants lodge with the Division provinciale de l'Emploi et du Travail rather than the CNEE secretariat in Kinshasa. And before you accept a posting that involves travel east, read Loi 86-007.

The CNEE work card at USD 280 is the figure with a clean published trail. Establishment-visa tariffs circulating in Congolese sources are about USD 653 for work, USD 700 for ordinary professional and USD 100 for students, plus DGM form and filing fees — none confirmed officially. Your employer separately pays the 25% IERE on your gross salary.
Time needed
Six months in country before the establishment file starts, then months for the CNEE and DGM steps, plus transit time that a Kinshasa file does not have. Organisations that post staff here routinely have this planned; a first-time employer will not.
Validity
Work establishment visas run with the work card, at most two years; the ordinary category runs three years and renews. No published rule converts either into permanent status, and naturalisation means surrendering your existing nationality, because Congolese nationality is one and exclusive under Loi n° 04/024.

    Apply through the DGM portal at evisa.gouv.cd or at a Congolese mission. Travel visas run eight days to six months and must be used within three months of issue. A Congolese sponsor is a substantive requirement. Note that reaching Kisangani means a domestic connection through Kinshasa — Bangoka's scheduled service is currently domestic only — so build the internal leg into your travel plan and your visa validity.

    Your employer files the work card provincially

    Applicants outside Kinshasa lodge with the Division provinciale de l'Emploi et du Travail, which feeds the same national commission. The chain afterwards is identical — commission, DGRAD note de perception, payment, biometric capture, card printing, delivery through the Ministry.     File the establishment visa at the DGM's provincial direction

    Categories under Ordonnance 87-281: work (running with the work card, two years maximum), ordinary (three years, renewable, own means), special (five years, investors approved under the investment code), studies (one year) and missionary (five years, renewable). The missionary and study categories are used more here than in most of the country — the church and university presence is substantial.

    Settle the mining-zone question before you accept field travel

    Loi 86-007 du 27 décembre 1986 prohibits foreigners from staying or circulating in designated mining zones, with six months to two years' imprisonment and blacklisting as an undesirable after expulsion. Article 1 lists all of Ituri and Haut-Uélé, Bondo, and — inside Tshopo — Bafwasende, alongside both Kasaïs and territories in Kivu, Maniema, Bas-Congo and Bandundu. Kisangani itself is not listed. Exemptions and circulation permits go through an interdepartmental commission chaired by territorial administration under arrêté 86/0663.

    Renew early, because everything here takes longer

    The work cycle is tied to a card of at most two years; the ordinary category runs three years. Ordonnance-loi 83-033 art. 22 makes irregular stay criminal, with servitude pénale and a fine, and art. 15 permits expulsion. In a city where a document may need to travel to Kinshasa and back, three months' lead time is a minimum rather than a comfort.

Things most newcomers don’t know

The mining-zone ban reaches into this province, and almost nobody mentions it.

Loi 86-007's Article 1 names Bafwasende — a Tshopo territory — as well as all of Ituri and Haut-Uélé immediately east. For a humanitarian, forestry or research role based in Kisangani but working eastward, that turns an ordinary field trip into a question about a 1986 criminal statute. Ask the Ministry of the Interior and the DGM directly; do not take a colleague's word or a web page's.

The work card comes before the visa, and the order is what costs people time.

Ordonnance 87-281 art. 9 makes a valid carte de travail the condition of the work establishment visa. The intuitive order is backwards here, and in July 2024 the Ministry of Employment announced a nationwide inspection mission of employers of foreign workers specifically to find people working without one.

Distance is a compliance risk, not just an inconvenience.

When a file has to travel and a renewal window is fixed, the failure mode is administrative rather than deliberate. Long-term residents here build in months of slack that a Kinshasa resident would consider excessive, and they are right to.

There is still no nomad, freelance or retirement visa anywhere in Congolese law.

The categories are the five in the 1987 ordinance plus what the DGM applies in practice. If you are self-supporting, the honest answer is the ordinary establishment visa — three years, renewable, with a means test that has no published threshold. Anything advertised as a 'DRC remote work visa' does not exist.

Common mistakes to avoid

  • Accepting a role with eastward field travel before checking Loi 86-007
  • Arriving expecting to land on an establishment visa — six months of prior lawful residence come first
  • Leaving a renewal to the last month when the file has 2,900 km to travel
  • Paying anyone anything without a DGRAD note de perception
  • Photographing the port, government buildings or bridges, which is a reliable way to be detained
  • Assuming advice written about Kinshasa's timelines applies to a provincial file
